Licence Agreement

Version 1.0. This is the same agreement the plug-ins show on first launch.

This agreement is between you and Radikaal Group Oy ("Sacred Audio", "we"). It covers each Sacred Audio product and every other Sacred Audio software product, including its presets, sounds, documentation and updates (together, "the Software"). By installing or using the Software you agree to these terms. If you do not agree, do not use the Software and ask the shop you bought it from for a refund under its refund policy.

Licence

We grant you a personal, non-exclusive, non-transferable licence to install and use the Software on computers that you own or personally use. A licence belongs to one person (or, for a business licence, one workstation seat). You may keep backup copies of the installer and your licence key.

What you own

Music, audio, recordings, performances, sessions and healing work you create with the Software belong to you. You may use them commercially without royalties or credit. Presets you create are yours.

What you may not do

You may not: (a) share, sell, rent, lend or publish your licence key or the Software; (b) remove, disable or work around the licence check, trial or demo limits; (c) decompile, reverse engineer or modify the Software, except as far as the law expressly allows despite this restriction; (d) redistribute the factory presets, sounds or impulse responses as a product of their own, for example as a sample pack or preset bank for another product.

Trial, demo, nfr and educational licences

The trial runs fully for a limited time. After it ends the Software keeps working in demo mode, where the output is briefly silenced at regular intervals, until a licence key is entered. Not-for-resale (NFR) licences are for review, demonstration and artist use and may not be sold. Educational licences are for students and teachers of accredited institutions.

Transfer

You may transfer your licence once to another person if you stop using the Software and they accept this agreement. Contact support so we can move the licence into their name. Resellers' NFR and promotional licences cannot be transferred.

Licence keys and deactivation

The Software checks your licence key offline; it does not send personal data anywhere. We may deactivate keys that were obtained fraudulently, charged back, refunded or shared publicly. If the Software can check for updates, it downloads a small public file that may list deactivated keys; you can turn this off in Settings.

Updates

Updates within the same major version are free. Major upgrades may be paid. We may stop developing or supporting a product, but the version you bought keeps working with your key.

Not a medical device

The Software is a creative and relaxation tool. It is not a medical device and does not diagnose, treat, cure or prevent any disease or condition. Descriptions of frequencies, brainwave states, chakras, intentions or traditional systems are artistic and cultural, not medical claims. See the Health & Safety notice in the Software. Do not use entrainment features while driving or operating machinery. If you have epilepsy, a seizure disorder, a heart condition, a pacemaker or another implanted device, a psychiatric condition, or are pregnant, ask a doctor before use.

Hearing

Listen at moderate levels. The Software can produce low frequencies and sustained tones that are tiring or harmful at high volume, especially on headphones.

No warranty

The Software is provided "as is". As far as the law allows, we make no warranties beyond those that cannot be excluded, and we do not guarantee that it is free of errors or fit for a particular purpose. Nothing here limits the rights you have as a consumer under the law of your country, including the European Union's consumer protection rules.

Limitation of liability

As far as the law allows, our total liability under this agreement is limited to the price you paid for the Software. We are not liable for lost data, lost profits or indirect damage. This does not limit liability for death or personal injury caused by negligence, for wilful misconduct or gross negligence, or any liability that cannot be limited by law.

Privacy

The Software does not collect personal data. Your licence key contains the name and e-mail you gave when buying and stays on your computer. The optional update check sends the product name and version only.

Termination

This licence ends automatically if you break it. When it ends you must stop using the Software and delete it. Sections 2, 8, 10, 11 and 14 survive.

Law

This agreement is governed by the laws of Finland, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.

Health and safety notice

This plug-in can produce binaural beats, isochronic pulses, slow modulation and visual patterns designed to influence how you feel. Most people find them relaxing. Please read this before you listen.

Do not use while driving, cycling, operating machinery, or doing anything that needs your full attention.

Ask a doctor first if you have epilepsy or a history of seizures, a heart condition, a pacemaker or other implanted device, a psychiatric condition, or if you are pregnant. People with photosensitive epilepsy should also avoid flashing visuals.

Stop listening if you feel dizzy, anxious, nauseous, disoriented or unwell. Most effects fade within minutes.

Keep the volume moderate, especially on headphones. Binaural beats need headphones; they work at low volume.

Not for children without supervision.

This is a creative and relaxation tool, not a medical device. It does not diagnose, treat, cure or prevent any condition, and is not a substitute for professional care. When you guide others (sound healing sessions, classes), let them know what to expect and that they can stop at any time.
